Serviced Accommodation Licence to Occupy — Medium Term Stays (28 Days to 6 Months)

1. The Parties and the Accommodation

The Licensee (The Guest): As set out in the booking confirmation.

Maximum Permitted Occupants: The Licensee and named guests only, as recorded in the booking. Occupancy must not exceed this limit, in order to comply with HMO and fire safety regulations.

2. The Licence Period and Fees

Start Date: from 3:00 PM on the check in date shown in the booking.
End Date: by 11:00 AM on the check out date shown in the booking.

Licence Fee: agreed rate through the PMS.
Payment Due Date: start date of the contract (one month in advance).
Damage Retainer: £350 damage deposit or £50 damage waiver.

Stays exceeding six months require a new agreement to be negotiated. The Damage Retainer is a commercial retainer held against damage, breakages or unpaid fees. It is not a tenancy deposit and is not subject to tenancy deposit protection schemes.

3. Nature of the Agreement and Service Provision

3.1 No Tenancy Created: This Agreement grants the Licensee a personal, non exclusive and revocable permission to occupy the Accommodation for the Licence Period. It does not create a lease, an Assured Shorthold Tenancy or an Assured Periodic Tenancy.

3.2 No Exclusive Possession: The Licensee acknowledges that they do not have exclusive possession of the Accommodation. The Licensor retains possession and control of the Accommodation at all times.

3.3 Mandatory Servicing: As this is Serviced Accommodation, the Licensor, its staff, agents and contractors will enter the Accommodation on a regular basis to provide mandatory services. The Licensee cannot refuse these services. Entry will occur for weekly or fortnightly cleaning and linen changes, routine inspections, repairs, maintenance, statutory safety checks and in the event of an emergency.

3.4 Right to Relocate: The Licensor reserves the right to require the Licensee to move to alternative, comparable serviced accommodation within the Licensor's portfolio upon giving reasonable notice, should operational or maintenance needs require it.

3.5 Not a Principal Home: The Licensee warrants that the Accommodation is provided for temporary purposes only, for example corporate placement, temporary relocation or extended holiday, and that the Licensee maintains a principal permanent residence elsewhere. The Licensee must not register the Accommodation address for voting, DVLA, banking or as their primary residence.

4. Licensee's Obligations

4.1 Payment: To pay the Licence Fee in advance on the agreed Payment Due Dates without deduction or set off. Late payments will incur interest at 3% above the Bank of England base rate.

4.2 Use of Accommodation: To use the Accommodation solely for private, temporary residential purposes. The Licensee must not run a business from the Accommodation, use it as a registered company address, or use it for any illegal, immoral or anti social purpose.

4.3 Occupancy: Not to allow any person other than the Permitted Occupants to stay overnight. The Licensee must not assign, sublet or share the benefit of this Licence.

4.4 Conduct and Nuisance: Not to cause any nuisance, annoyance or disturbance to the Licensor, other occupiers of the building or neighbours. This includes strict adherence to quiet hours between 10:00 PM and 7:00 AM.

4.5 Care of the Property: To keep the Accommodation and its fixtures, fittings and furnishings clean and tidy between scheduled servicing. The Licensee must pay for the repair or replacement of any items damaged by the Licensee or their visitors, fair wear and tear excepted.

4.6 Alterations: Not to make any alterations or additions to the Accommodation, nor to affix anything to the walls, doors or windows.

4.7 Smoking and Drugs: Smoking, vaping and the use of illegal drugs as defined by the Misuse of Drugs Act 1971 are strictly prohibited within the Accommodation and the wider building.

4.8 Pets: Not to keep any pets or animals in the Accommodation without the prior written consent of the Licensor.

4.9 Keys and Security: Not to copy any keys or access fobs provided. Lost keys will incur a replacement charge. The Licensee must ensure the Accommodation is secure when unoccupied.

5. Licensor's Obligations

5.1 Services and Utilities: To provide the Accommodation fully furnished and to supply electricity, gas, water and broadband internet, subject to fair usage policies and provider availability.

5.2 Maintenance: To keep the structure and exterior of the Accommodation in good repair and to maintain the installations for the supply of water, gas, electricity and sanitation.

5.3 Statutory Safety: To ensure the Accommodation complies with all relevant statutory safety requirements, including a valid Gas Safety Certificate where applicable, an Electrical Installation Condition Report and current fire safety regulations.

6. Termination and Eviction

6.1 Notice by Licensor: The Licensor may terminate this Agreement without cause by giving the Licensee a minimum of 28 days' written notice, in accordance with section 5 of the Protection from Eviction Act 1977.

6.2 Notice by Licensee: The Licensee may terminate this Agreement by giving the Licensor a minimum of 28 days' written notice, expiring on a Payment Due Date.

6.3 Termination for Material Breach: The Licensor may terminate this Agreement immediately by written notice if the Licensee commits a material breach, which includes using the Accommodation for illegal activities including drug use, causing severe nuisance or harassment to neighbours or staff, refusing the Licensor entry to conduct mandatory cleaning, maintenance or safety checks, or subletting the Accommodation.

6.4 Termination for Non Payment: If the Licensee fails to pay the Licence Fee within 7 days of the due date, the Licensor may issue a written notice requiring payment within 7 days. If payment is not received, the Licensor may terminate the Agreement with immediate effect.

6.5 Eviction: Upon termination of this Agreement, the Licensee's right to occupy the Accommodation ends immediately. As an excluded occupier, the Licensee acknowledges that the Licensor is entitled to recover possession of the Accommodation peaceably without requiring a court order once the notice period has expired.

6.6 Belongings: If the Licensee leaves any personal belongings in the Accommodation after the termination date, the Licensor may remove and store them for a maximum of 14 days. If uncollected, the Licensor may dispose of the items. The Licensee will be liable for all reasonable storage and disposal costs.

7. Liability and Indemnity

7.1 Personal Property: The Licensor accepts no liability for loss of or damage to the Licensee's personal property, vehicles or valuables kept at the Accommodation, unless caused by the Licensor's negligence. The Licensee is advised to obtain their own contents insurance.

7.2 Indemnity: The Licensee agrees to indemnify the Licensor against all claims, liabilities, costs and expenses arising from the Licensee's breach of this Agreement or any injury or damage caused by the Licensee or their visitors.

8. General Provisions

8.1 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any disputes.

8.2 Entire Agreement: This document contains the entire agreement between the parties and supersedes any prior agreements or representations.

8.3 Data Protection: The Licensor will process the Licensee's personal data in accordance with the Data Protection Act 2018 and the UK GDPR, solely for the purposes of managing this Agreement. Please see our Privacy Policy for further detail.

By signing at the point of booking or check in, the Licensee confirms that they have read and understood this Agreement, that they maintain a principal residence elsewhere, and that they understand this Agreement grants a commercial Licence to Occupy Serviced Accommodation only and does not create a tenancy.
